If you thought Candy Crush Saga game invites were annoying, prepare yourself—the next time you try to say the word "candy," you might just get sued. The company behind the game, developer King.com, has just successfully trademarked the word "candy."
Candy Crush Saga is one of the most popular games in the world today, and developer King.com has made millions off of the mobile and Facebook game. However, the company decided to take an unusual tack to generate even more money off the game by trademarking the word "candy" and forcing companies to pay for the right to use the incredibly common word.
The trademark application filed by the company last year on Feb. 6, 2013, was accepted on Jan. 15.
This trademark could have wide reaching implications as it will allow the company to file copyright grievances over the use of the very common word. King along with iPhone maker Apple have already served some developers with notices stating that they are violating their trademark to the word "candy," according to Gamezebo. Any company that thinks it will damaged by the King.com's trademark has "30 days from the application being published to challenge the registration or request an extension to oppose," as Polygon reports.
The uproar over the trademark is already so great that King had to release an official statement to GamesIndustry International about the move.
"We have trademarked the word 'CANDY' in the EU, as our IP is constantly being infringed and we have to enforce our rights and to protect our players from confusion. We don't enforce against all uses of CANDY - some are legitimate and of course, we would not ask App developers who use the term legitimately to stop doing so," King wrote in a statement.
The company provided one case of how this new trademark would be used on one of the games that have already been given notice, "Candy Casino Slots - Jewels Craze Connect: Big Blast Mania Land."
"The particular App in this instance was called 'Candy Casino Slots - Jewels Craze Connect: Big Blast Mania Land', but its icon in the App store just says 'Candy Slots', focusing heavily on our trademark. As well as infringing our and other developer's IP, use of keywords like this as an App name is also a clear breach of Apple's terms of use. We believe this App name was a calculated attempt to use other companies' IP to enhance its own games, through means such as search rankings," wrote King.
