For a second there, it looked like the perfect lives of the members of One Direction were about to take a drastic turn. After the group released their new song “Midnight Memories,” which currently sits at No. 12 on the Billboard charts, fans quickly picked up on its similarity to Def Leppard’s “Pour Some Sugar On Me.” Mirror UK then reported that Def Leppard were weighing their legal options, but that’s no longer the case. The One Direction boys just dodged a bullet.
According to Billboard, Phil Collen and Vivian Campbell, Def Leppard’s guitarists, confirm that the band is not pursuing legal action, stating that “Midnight Memories” is “very similar in structure,” but is not guilty of copyright infringement.
"The chords are one-four-five," Campbell says. "Those are the blues. You don’t get more basic than that. I think what’s more reminiscent of the Leppard thing is the production, the sound, the vocals, the reverb and the way it’s assembled.
"That is very flattering that all of a sudden these kids think it’s a cool sound. I think a lot of people of their generation aren’t going to connect their music to ours."
Earlier this year, Marvin Gaye’s family sued Robin Thicke for drawing too heavily from Gaye’s “Got to Give it Up” on his smash hit “Blurred Lines.” However, the issue between One Direction and Def Leppard is much different, Collen claims.
"That’s different," he says. "In fact it’s got the mayonnaise jar and people hooting in the background which Marvin Gaye had. I don’t see that you can do that. The One Direction one is very similar in structure, but it’s all good."
In fact, Def Leppards viewpoints lie at the core of Thicke’s argument. These chord progressions and song structures run rampant through basic pop music. Bands of all genres have been using the same progressions with slight variations for decades. It’s simply the modern state of music. It’s nearly impossible to claim one person ripped off another song without accusing every single artists in the industry of the same crime.
Unlike Thicke, the members of One Direction can take a long, deep breath and be thankful that Def Leppard won’t put them under the gun.
