Rihanna Wins Case Against Topshop Sleeveless Shirts With Her Image

In a legal battle concerning an image of Rihanna on Topshop shirts, the Court of appeal upheld their ban on the sale of the tank tops without the star's permission.
The three-judge panel in London upheld the decision made by a lower court as using the singer's image without her approval is considered a "passing off" of an unregistered trademark, as noted by Bloomberg. While the owner of Arcadia Group (which also owns Topshop) Philip Green got permission from the photographer to make use of the image, he did not obtain the same from the singer, leading Rihanna's lawyers to argue that the customers of the store were deceived into thinking that the shirts were sold with her approval.
According to BBC, the image that was used by Topshop was taken during a music video filming in 2011, and Topshop lawyers insisted that the claim made by the singer was an "unjustifiablebid to establish a 'free standing image right'" over the use of her photos in the UK.
Topshop was said to be "surprised, disappointed, and perplexed" of the decision of the high court. A statement from the brand said, "There was no intention to create an appearance of an endorsement or promotion. We feel that the fact that Rihanna has shopped, worn and had a relationship with Topshop for several years appears to have been detrimental to our case."
In an analysis, it was discussed that Rihanna's case was different from other celebrities whose photos appear on clothing apparels. Although there is no "personality/image right" in the UK, and the photographer who took the photo owns the right to the image, Rihanna's previous association with Topshop increased chances of customers thinking that she endorsed the product, therefore it is considered as a "passing off."
The relationship with the singer that Topshop was speaking of was a previous association with the brand's contest - the winner gets to go on a shopping trip with the 26-year-old singer.
Lawsuits aside, it seems that Rihanna is not only winning at cases, apparently, she is finally winning at love, as well. According to the Hollywood Life, the singer has invited her latest rumored beau, Leonardo diCaprio, to go with her to Barbados to meet her family. A source said that the singer is very smitten with the 40-year-old actor and is ready to let him meet her family.
A source for In Touch said, "Rihanna doesn't bring a guy home unless she really likes him. This is a sign she adores him."
