Ex-Florida State QB Jameis Winston Sued for Sexual Assault
Three years after the alleged sexual assault involving former Florida State University (FSU) quarterback Jameis Winston, the woman who accused him of the crime finally filed charges against him on Thursday.
A Time report said that the lawsuit filed in the Circuit Court of the Ninth Judicial District is all about claims of "sexual battery, assault, false imprisonment and intentional infliction of emotional distress arising out of forcible rape."
It added that the attorney of the accuser tagged Winston as "an entitled athlete who believes he can take what he wants." Quoting the statement provided by her legal counsel, Time said that the client will not be silenced even with the efforts of Winston's camp.
"Over the past two years, this survivor of sexual violence has had to endure a delinquent police investigation, a hostile FSU athletic department, and Mr. Winston's bullying lawyer. But the more these forces sought to silence her, the more determined she has become to step forward and hold Jameis Winston accountable for his actions. With the support of her family, she is prepared for this fight and for the counterclaims and the smear campaigns that will surely follow," the statement further read.
Tampa Bay noted that the case was filed after a series of investigation against the football player who has claimed he is innocent from the allegations. It seems to be the perfect timing as the Tampa Bay Buccaneers are expected to draft Winston during the first round of the NFL draft two weeks from now though the case will have no bearing on the the team's decision.
The aggrieved party is reportedly seeking damages in excess of $15,000 and a jury trial as they claim that the football player's behavior "went beyond all possible bounds of decency and was shocking, atrocious and utterly intolerable in a civilized society."
In 2013, the State Attorney's Office did not pursue the charges against Winston citing lack of evidence in the case. FSU also reportedly had their own hearing to find out if the football player violated the conduct code of the school. Time, however, explained that he was cleared after a two-day hearing where he denied all the allegations in a five-page statement, this being his first time to speak about the sexual assault issue.
In explaining the case, Tampa Bay detailed that the case stemmed from an incident in December 2012 where the woman claimed that the football player raped her in the bedroom and then in the bathroom of his own apartment while she appeared to be "impaired" and disoriented.
Because of the alleged sexual assault, Tampa Bay added that the accuser "suffered loss of sleep, flashbacks, severe anxiety and depression, which hurt her education and her enjoyment of life."
